I don't see why it requires absolute positioning.
you might have problems with IE5 on Mac for different reasons - it's
notoriously difficult to please IE5 on the mac when you're pushing the CSS
envelope, but the layout in your jpg should be quite simple to do. I bet
you're not paying your xhtml coder enough.

if he's wroking for free and you really want IE5 mac support then tell him
it's a great learning opportunity.
I'm not sure how many people are actively designing to support IE5 on Mac,
I for one code to web standards and hope for the best... (I usually tweak
for IE6 so it doesn't look too weird)
