I think the general rule should be first come, first served.
If someone can afford patent rights for a name, he should
also be able to register the domains he wants.
If the domain is already used, bad luck for him.
As said this as a general rule, there are always cases,
which might be different.

I think it should be ok if I can work against that,
but not, repeat, not, if I am a person of public life,
like a politician for example.
Name-rights (natural) ones seem to loose at court anyway.
Let's pretend I am Mr. Microsoft, though I have born rights
to that name in the laws, in court I would be snowball in hell
if I want that domain back.
But on the other hand, if company Mueller in Germany
wants the Domain of a private person with the name
Mueller and succeeds before court, as happened,
I am strict against it, therefor the general rule of first
come first served.
Same for government bodies, it is not ok for military in AT
for example to attack bundesheer.com (bundesheer-name
of military in AT), where a forum against compulsary military
service operates.
If the government bodies care about the name, then they
should reserve it.
Quite often it seems domain issues are used to silence
critical people, which is something that should be worked
against.
ok, I play only domain lawyer on the Internet ;)
(though through media studies and ex-lawyer girlfriend
who I helped study, I know at least some things about
local law, or so I pretend).
So, if any lawyers, or other different thinking people are on thelist,
please feel free to voice your opinion.
