Everything can be documented and proved in a court of law.

Perhaps "We can and will if necessary prove in a court of law that each
image and display element originally came from evolt.org"

No capital on the Not.  My suggestion - "We have the will and the resources
to pursue the matter legally, but we prefer to handle this without legal
action.  Should you change your website so that it does not copy ours by
(somedate), we will drop this matter."

Don't forget to thank him for his time or something at the end.  *s*
Politeness goes a long way.
