I reckon it depends on the license. It's difficult to know whether the
company that owns the script still exists in some shape or form. I would
assume however that someone somewhere still holds the rights to the program.


I think given the circumstances that editing the code for use on another
site would not be immoral. If you make the best attempt you can to track
down the license holder and can't find them, then they aren't making it
especially easy for you to buy a new copy! If they were to pop up and
suddenly start demanding a license fee, then I'm sure it would be a simple
matter to negotiate payment.

Of course, selling the script on would almost certainly be immoral - but
that's obviously not what you are interested in anyway.

I think the idea of checking WHOIS is probably the best bet to try and find
them, also searching Google may throw up traces of them. You may find
bulletin board or newsgroup conversations about the company for example.
Finally, have you tried using the email adresses that came with the game
originally? Even if they have closed their doors, they may have mail
forwarding or something.
