NSI has been doing this for months, over a year.  I could point you to a domain
that 'expired' 18 months ago and yet is not available.  You might read through
the chaff of other issues and see some of the discussions about this at the
OpenSRS discussion list:

Just search the archives and you'll find out more about this issue than you 
really wanted to know.  Good luck - and keep plugging.  "weird.com" was 
'expired' for almost 9 months before it was release earlier this year - and I
missed getting it by 1 day.  (Someone was running a script that checked every
hour, or so he told me.)
