ya, we're sending a custom 404, but a status code of 404 still gets 
returned to the client, which is the problem..

if we hack apache or cf to return nothing but 200's(i did this yesterday 
too to try it out) then our 404 templates never get called because the 
server is saying the page is found(200) even though its not.. even 
worse, the 404 template never gets called for the same reason, leaving 
you in worse shape than before :)

and besides, thats just bad karma fucking with rfc's that much :)
