I would amend this to *registered* trademark...

Anyone can use a mark, be it a word, or symbol as a trademark for their
products, and in so doing, claim the rights to that trademark. Usually the
(tm) symbol is appended to these marks.

Registration of a trademark gives you greater protection and generally
makes defense of your trademark a little less complicated. Registered
trademarks usually have a (R) symbol appended to them.
