A far more elegant solution can be found to this problem
(provided that you are willing not to force those w/o
Javascript enabled to open a new window). Our good friend
Jeff Howden at Evolt has already covered this topic (although
he was referencing JS abuses, not Doctype compliance).

I'm using this technique on my new site (XHTML Strict) ... it
works great and validates every time.
