It's only different in that Eolas can't get as much money from them.  Just because it's now under the auspices of a non-profit foundation doesn't mean they can't be sued (possibly out of existence) to comply with the patent.  

If that were the case, Microsoft could just spin off IE into a non-profit foundation. (Remember, Mozilla was a Netscape project until a couple of months ago.)
