The Georgia Supreme Court this afternoon hears a challenge to the state
fornication law, which makes it a crime for a person to have sexual
intercourse outside of wedlock.

The appeal is being filed by lawyers of a 16-year-old boy who was found
having sex with his girlfriend. The girl's mother found the two in her
Fayette County home. The boy, identified in court papers as J.M., was
sentenced in Juvenile Court to pay a fine and write an essay.

Under Georgia law, a fornication conviction is a misdemeanor offense and
can bring up to a year in prison and a $1,000 fine.
