If you mean legal in terms of the UN Charter, there is no question 
whether it's legal or not.

There are only two types of war recognized as legitimate by the UN:

1. A war waged in response to an unprovoked attack.
2. A war approved by the Security Council.

Interestingly, regarding #1, the UN Charter now allows any member 
country to legally attack the United States.
