Dan,

remember that the "referrer" cgi variable does not work 100% of the time as
not all browsers send it.  It may be possible to pass something via the URL
that would indicate that they didn't skip the TOS, or put a form on the TOS
and pass in the variable by hidden fields or something.  It's not perfect,
but it will keep casual users from skipping it.
