i'm not a fan of the persistent menu either; if you scroll single lines at a
time, it has a very distracting jerky appearance. but i don't think that's
the cause of the scrollbar problem. i've seen other sites that use similar
techniques:

and they don't have this problem. i tend to agree with DC that it's probably
related to the positioned DIVs.
