Let's simplify this.  Spammers fill the internet with spam and some attach Confidentiality Notices such as the above.  My take on this is that unless you have signed or agreed to a confidentiality policy in advance, you are not legally bound to honor the notice. It's vapor - and vapor probably intended to keep their tactics private.
