it does happen. 
A friend of mine has a cron job he runs that queries and tries to
register a list of domains he's trying to get hold of, on a nightly
basis. 
He got me one I'd been after, and his own name - both weren't in use and
we (correctly) figured were likely to lapse. 

Others may have more malicious/commercial intentions,
