Then why can software companies get away with it? I've never heard of a
software company being sued for developing buggy software. I'm sure that
even smaller companies could lose more than $8k/day to bugs in software and
operating systems.

I should point out should a consumer in the US sign a contract
filled with legalese nonsense like this, without first taking
legal counsel, the contract is basically worthless in almost all
US jurisdictions as well.
