The difference is that you didn't contact miscrosoft to create the
program abiding to your needs nor it is based on your primary idea of a
product...
If you had a store such as Chapters...and you hired someone to create
the backend for an online store...wouldn't you want to have the right to
modify it whenever your store grew and the online store needed to have
more categories added or more ways buy the products added? Would you be
willing to stay tied to the first programmer if you noticed that it took
about 3 months to get any modification done to your site while you are
losing money for not having those additions made on a timely basis?
That is where I am trying to find out...where do we draw the line
between the programmer's rights and the client's rights...
When you create a plain HTML site and you hand the final product to the
client and you get paid in full then the client owns the right ot the
page in full right? Or not? 
Gee...I am getting more confused than before now....
I am just asking these questions because I would like to know where I
stand as a designer with all the new legislation regarding web
design/development coming out....
