My brain isn't firing on all cylinders today :o)
I also had the xhtml 1.0 strict dtd open, and  was looking at it's html
element:

<!ELEMENT html (head, body)>

Wherein the html element isn't optional

(still, I can't see any point in having a root element if you don't even
need the damn thing :o)
