One being that a web designer does have copyright over their design I know,
but if the site owner does not mention copyright anywhere within the site
or it's underlying code, what then?

Under current law, copyright vests in the creator at the moment of creation.

No notice is required. No registration is required.


However, expression of a notice may be helpful to a lawsuit.

And, registration is required to seek punitive damages.
