The Harkin Letter is not:

1. A regulatory agency ruling
2. Statutory law
3. Common law (court decisions)

It isn't law. It's a bit of advice from an agency within the executive
branch of the government, who are just as bound by decisions of the U.S.
judiciary as you or I (though John Ashcroft and G.W. Bush appear to be
trying to change that).
