The design company owns the domain name.

They are "owner of record". Regardless of who uses it, or why it was
claimed (the domain name). And yes, many design shop and ISPs do just
this to "make life easier". But then, I don't but that. It just makes
you hostage to them.

If someone else "owns" a domain name, and you can show legal rights to
it (now that's a whole 'nother kettle of fish!) you can appeal to
InterNIC.

You can lodge a complaint with InterNIC (or who ever runs it now) to get
ownership of the domain back from the design company.

But, they want $1500 upfront to start the judication process just to
review your claim.

This may, or may not work.

Like I said, and someone else as well; jus ask them for it, see what
happens.
