should we look at approaching it in a different manner then?

suggestion ...

if pic exists .. do not show upload box (still show pic tho).  Instead, have
a link/checkbox that says [modify photo] which when clicked (or selected)
redraws the page and shows the upload box? i.e. negating the if pic exists
..

if modify photo selected
    show upload box
elseif pic does not exist
     show upload box
else
    show [modify photo] link only
endif

or something like that.  ;)

Or we do all the upload photo logic on a separate page all together.
